INTO PICKLEBALL GENERAL PROMOTIONAL TERMS, CONTEST RULES, AND MEDIA RELEASE AGREEMENT

Welcome to IntoPickleball.com. These General Promotional Terms, Contest Rules, and Media Release Agreements (the “General Terms”) govern any and all sweepstakes, contests, giveaways, challenges, tournaments, and promotions (each a “Promotion”) operated by IntoPickleball, Inc. (“IntoPickleball”), its parent, corporate affiliates, subsidiaries, and advertising or promotional agencies (collectively, “the Company,” “we,” “us,” or “our”).
By participating in any Promotion, entering a contest, uploading media, or interacting with a promotional campaign hosted by the Company or its designated co-sponsors/affiliates, you (“Entrant,” “Participant,” or “you”) fully and unconditionally agree to be bound by these General Terms, as well as any specific rules, timelines, and instructions unique to an individual campaign (the “Specific Promotion Rules”). In the event of a conflict between these General Terms and any Specific Promotion Rules, the Specific Promotion Rules will govern for that individual campaign.
1. Eligibility & Absolute Employee Exclusion
Unless explicitly stated otherwise in the Specific Promotion Rules for a particular campaign, all Promotions are subject to the following eligibility requirements:
Residency & Age: Promotions are open only to legal residents of the United States who are at least eighteen (18) years of age or the age of majority in their jurisdiction of residence at the time of entry.
Employee Exclusion: Officers, directors, members, managers, employees, independent contractors, representatives, and agents of IntoPickleball, Inc., its co-sponsors, prize providers, advertising/promotion agencies, and any affiliated entity involved in the development, production, implementation, or execution of a Promotion (collectively, the “Promotion Entities”), as well as the immediate family members (defined as spouse, parents, siblings, children, and their respective spouses, regardless of where they reside) and household members (whether related or not) of each such person, are strictly ineligible to enter, participate in, or win any Promotion.
Void Where Prohibited: All Promotions are void where prohibited or restricted by local, state, or federal law. Any entry submitted by an ineligible individual will be deemed void ab initio, and any prize awarded to an ineligible individual must be immediately returned to the Company.
2. Comprehensive Media Release & Grant of Rights
By entering a Promotion, submitting any content (including but not limited to videos, reels, photos, audio recordings, text, captions, user-generated clips, or stories, collectively referred to as “Submission Content”), or accepting a prize, you grant the Company, its co-sponsors, and their respective legal representatives, affiliates, successors, assigns, and licensees (the “Licensed Parties”) an absolute, perpetual, irrevocable, worldwide, royalty-free, fully sub-licensable, and non-exclusive right and license to:
Use, reproduce, modify, edit, adapt, crop, arrange, publish, translate, create derivative works from, distribute, perform, broadcast, stream, and display your Submission Content, in whole or in part, on any media, platform, print, packaging, digital channel, or technology now known or hereafter developed, throughout the universe, for any purpose whatsoever. This includes, without limitation, commercial, trade, advertising, marketing, publicity, and future promotional campaigns, without further notice, review, approval, or compensation to you or any third party.
Capture, record, use, and publish your name, username, social media handle, biographical information, voice, image, likeness, silhouette, statements, and performance (collectively, your “Likeness”) in connection with the Promotion, marketing campaigns, or the general business operations of the Licensed Parties, in perpetuity, without geographical or temporal limitation, and without compensation, credit, or approval.
By submitting an entry or content, you represent and warrant that:
You are the sole and exclusive creator and owner of the Submission Content, or you possess all necessary, valid, and legally binding licenses, rights, and clearances to grant the rights specified above.
The Submission Content is original and does not infringe upon, misappropriate, or violate the intellectual property rights, trademarks, copyrights, moral rights, rights of privacy, rights of publicity, or any other proprietary, contractual, or personal rights of any third party.
You have obtained explicit, written permission from any other individual who appears, is heard, or is otherwise identifiable in the Submission Content to grant the Licensed Parties the rights detailed herein.
The Submission Content complies with all applicable platform community guidelines (e.g., Instagram, TikTok) and does not contain material that is unlawful, harmful, defamatory, libelous, obscene, or otherwise inappropriate.
Indemnification: You agree to defend, indemnify, and hold harmless the Company, the Promotion Entities, and their respective officers, directors, employees, and agents from and against any and all claims, demands, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or resulting from a breach of any warranty, representation, or covenant made by you herein, or from any third-party claim relating to your Submission Content, Likeness, or participation in a Promotion.
4. Limitation of Liability & Release
By participating in any Promotion, you agree to release, discharge, and hold harmless IntoPickleball, Inc., its co-sponsors, social media platforms (including Meta Platforms, Inc./Instagram and ByteDance/TikTok), and their respective affiliates, officers, directors, employees, and agents (the “Released Parties”) from any and all liability, claims, losses, damages, injuries, or actions of any kind resulting from:
Your participation in the Promotion, the preparation for participation, or the submission of content.
The receipt, possession, use, misuse, acceptance, or delivery of any prize (including any travel, event attendance, physical activity, or sport participation related to a prize).
Technical failures of any kind, including malfunctioning networks, servers, internet connections, hardware, software, or social media platform algorithms.
Unauthorized human intervention, typographical errors, formatting errors, or administrative errors in the administration of the Promotion or the processing of entries.
5. Disclaimer of Third-Party Platform Sponsorship
Unless expressly stated otherwise in Specific Promotion Rules, all Promotions are in no way sponsored, endorsed, administered by, or associated with Instagram, Facebook, TikTok, YouTube, X (Twitter), or any other third-party platform on which the Promotion is advertised, tracked, or conducted. You understand that you are providing your information and content to the Company and its designated co-sponsors, and not to these third-party platforms. You fully release all such platforms from any liability related to the Promotion.
6. General Prize Conditions & Winner Requirements
General “Win a Prize” Giveaways: For simple promotional giveaways where multiple entries are explicitly permitted by the Specific Promotion Rules (e.g., “tag a different friend for an extra entry”), participants may submit multiple unique entries up to any limits specified in that individual campaign.
Sweepstakes Restrictions: Unless otherwise specified in a campaign’s Specific Promotion Rules, sweepstakes and random-draw contests are strictly limited to one (1) entry per person, per household, and per social media account/email address during the promotional period.
Anti-Spam & Automated Systems: The use of automated entry software, script, macro, robotic, or other entry generation devices or systems is strictly prohibited. Any attempt by a participant to obtain more than the stated number of entries by using multiple or different email addresses, social media profiles, identities, registrations, logins, or any other manipulative methods (such as “ballot-stuffing”) will completely void all of that participant’s entries, and they will be instantly disqualified from the Promotion and future Company events.
7. Non-Transferability of Prizes, Gifts, and Awards
Strict Non-Transferability: Any and all prizes, gifts, promotional items, access passes, or digital rewards awarded by the Company are strictly non-transferable and cannot be assigned, sold, traded, bartered, or gifted to any other individual, third party, or entity.
No Cash Substitutions: No cash liquidations, cash redemptions, or prize substitutions are permitted, except at the sole, absolute discretion of the Company. The Company reserves the right to substitute a prize (or any component thereof) with one of equal or greater retail value if the designated prize becomes unavailable for any reason.
Winner Identification Check: To claim and utilize any ticket, VIP court-side access pass, or event registration portion of a prize, the official selected winner must present a valid government-issued photo ID that matches the registration and affidavit information provided to the Company. Failure to match registration details or attempting to pass an award to a third party will result in immediate forfeiture of the entire prize package without compensation.
8. General Prize Conditions & Winner Requirements
Taxes & Expenses: Winners are solely responsible for any and all local, state, and federal taxes associated with prize acceptance, as well as any travel, lodging, incidentals, or transportation costs not explicitly detailed in the Specific Promotion Rules.
Documentation: To officially claim a prize, selected winners must respond within the timeframe specified in the Specific Promotion Rules and may be required to sign and return an Affidavit of Eligibility, a Publicity/Media Release (reinforcing these terms), and required third-party liability or event waivers. Failure to comply may result in immediate forfeiture of the prize and the selection of an alternate winner.
9. Governing Law and Dispute Resolution
All issues and questions concerning the construction, validity, interpretation, and enforceability of these General Terms or the rights and obligations of participants and the Company shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules.
Any legal dispute, claim, or controversy arising out of or connected with a Promotion shall be resolved individually, without resort to any form of class action, exclusively before a court of competent jurisdiction located in Ventura County, California.
